Both to depositing and using data, agreements apply which are based on Dutch and European legislation and the ‘Code of conduct for use of personal data in scientific research’ of the Dutch Association of Universities (VSNU). This code of conduct is an elaboration of the Dutch Data Protection Act. The agreements are incorporated in the DANS Licence Agreement and the DANS Conditions of Use.

DANS licence agreement on deposited data
When a data file is deposited in EASY, a licence is granted. DANS enters into the Licence Agreement with the holder of the rights to the dataset. This can either be a person or an organisation.

The rules for data use are laid down in the DANS General Conditions of Use, in conjunction with the licence terms.

Privacy
Privacy-sensitive data
It may occur that personal data are incorporated in a dataset of, for instance, a social sciences survey: information relating to identified or identifiable living individuals.

Audio and visual data
Portrait right, which concerns the identifiable representation of persons, applies to visual data. In addition, visual and audio recordings may contain privacy-sensitive information.

The Copyright Act dates back to 1912 and offers protection from illegal exploitation by unauthorised persons.
